For the benefit of anyone looking at this drop, I just spent some time measuring the jeans I got from the previous drop (38"), comparing it to the stated size, and to a few other pairs of pants/jeans I have which fit me.
Seems like the N+F jeans run ~2" larger than the size chart. I'll be getting a 36" this time round, may try and sell the 38" if the 36" fits better.

knowyourbuzzDespite a lot of people saying the jeans are too tight, I found my pair to be too large and my measurements agree with your assessment. I'll be picking up a smaller size for my second pair.

Wasn't that listed in the provided size chart, along with other relevant measurements? I measured myself, and a couple of other jeans I have. 35" was the closest. So I ordered 33. It worked out, thankfully. So based on my experience, my 33" was fairly true to size. Your 38" does run a full inch larger than their supposed 39.5" though.

serifI think there was some inconsistency with how these jeans were made. My waist measures 34 inches so I ordered a 32, but the jeans I received have a 35" waist by my measure and are definitely loose, which is why I decided to go down another size. I don't mind having the looser fitting initial pair, I'll just switch to them when I inevitably gain more weight.

serifI meant they're bigger than the size chart says, I know the 38 was supposed to be 39.5, which would have been fine, but the 38 was actually 2" more at 41.5 when I measured. Glad yours was true to size, with MD not accepting returns it is a little annoying when clothes don't fit.

knowyourbuzzYeah, especially if the actual products are significantly off (an inch seems significant enough in the context of jeans) from the provided measurements. They should allow for returns in such cases where I would consider us, the buyer, to have been misled.
If they are expected to vary that much, the least they could do is indicate the possible range in their size chart so people can make a more informed decision. Just saying "it may vary" seems lazy and doesn't really help. I think MD could do better by their customers. I hate the uncertainty involved in ambiguous sizing. Looking at the other comments, I recognize I simply lucked out here.

serifyep, returns should be an option now especially since its an "in stock" "drop" now. (i.e. a production item they are just selling)

knowyourbuzzTHIS! I got size 38 and the waist is 42-43"! Guess I got extra baggy comfy jeans... not quite what I was going for tbh.
