Ares78Notification of Canadian International Trade Tribunal Decision on Centrifugal Opening Knives Customs Notice 18-01 Ottawa, January 5, 2018Revised date – Ottawa, January 10, 2018 1. This Notice is to advise interested parties that the Canadian International Trade Tribunal (CITT) has rendered a decision in  Appeal No. AP-2017-012, T. LaPlante v. President of the Canada Border Services Agency regarding knives which open automatically by centrifugal force (centrifugal knives). 2. In accordance with subsection 84(1) of the Criminal Code and the CITT’s recent decision in T. LaPlante, the CBSA resolves that centrifugal knives will be classified as prohibited weapons if the following conditions are met:
  1. a knife has a blade that opens by centrifugal force, when the blade is released from the handle into the fully ejected and locked position with a simple and brisk outwardly flick of the wrist; and
  2. it includes knives that require some preliminary or simultaneous minimal manipulation of either a flipper or other non-edged parts of the blade.
  3. Please be advised that the CBSA will immediately prohibit the importation of all knives by an individual that open as per the CITT’s decision. Importation by a business is permitted if a Firearms Business Licence has been presented with import – prohibited weapon, listed as a business activity on the licence. For more detailed information concerning the decision, please consult the decision posted on the Tribunal’s website at: CITT Appeal No. AP-2017-012.4. The CBSA’s policy on the importation of prohibited weapons is available in Memorandum D19-13-2, Importing and Exporting Firearms, Weapons and Devices. The Memoranda D19-13-2 will be revised to reflect the CITT decision on centrifugal opening knives.

BknguyenJust to be clear, the law has not changed, nor does CBSA has the power to change the law. What has changes is the interpretation of the law by these bureaucrats to prevent the average Joe like you and me to import the knives in order to save a few bucks, the law remains the same and you can buy tons of flippers from Canadian retailers (flippers that CBSA allow entry to the country btw). So yes, it is riskier now to import flippers to Canada as if CBSA decides to inspect the package, they might prohibit you from import it and then you'll need to do some paperwork and send it back through UPS which will cost you about $40 CAD (I did this last year). However, realize also that CBSA doesn't inspect every knife package that comes to the country, they probably inspect 1% of them so chances are high that you will get it, but not 100% (I just received yesterday a WE 604A that came from the US and it's a much bigger flipper LOL!) As for the law, don't worry, once the knife is in the country, no police officer will tell you that your Rike Hummingbird is a dangerous and prohibited weapon LOL!

bdpfAnd also, btw, CBSA's interpretation of the law to prohibit flippers changed back in November 2016, which is why I had to pay to export it back outside Canada, they seized it under being an automatic knife which it was not, it was a regular ball bearing flipper. What changed this past January is to extend their definition of prohibited weapons to also include other deployment devices like thumb studs, thumb discs, spydy holes, etc... if you can open the blade into locking position with them. examples: - Spydy hole flick, blade locks = prohibited - Thumb stud flick, blade doesn't open all the way, finish it with a flick of the wrist, blade locks = prohibited Basically, the way I look at it, the only folder that are not prohibited in CBSA's eyes are slip joints and most lock backs LOL! I know ... it sucks .... but again they won't stop everything.

daaperWell this is really dumb, you either have knifes with shit detent, which could be swung out, or you have knives with really hard detent, which would make them flip really well. I mean I've got 4 knives on the way (RK 1507, MDXFF Falcon EB, MDXFF Gent, Boker+ FR), wonder how many will I receive?

Ares78I'm on reddit pretty often and I haven't heard of any of them actually being confiscated YET, but I definitely wouldn't risk it with my money. They've worded it so vaguely that almost any folder could qualify as a centrifugal knife. Definitely sounds like a government entity overstepping its reach, which is a major bummer for Canadian knife collectors.
I've also heard of people requesting that the pivot screw be over-torqued so that the knife won't flip out under anything but ridiculous pressure. Might save your knife from being stopped, but who knows.

bdpfYep I understand. Doesn't affect what you own or are allowed to carry, but what the CBSA classifies and interprets as prohibited to enter Canada. Just sucks. I realize now that a knife that's been taking forever to get to me is probably stuck in customs. Also makes me think of folks who ordered the FF gent back in Sept (I was hoping to jump on the next drop) who now might have to jump through way more hoops if anything

daapernot going to risk...the change from custom is total BS since you can still buy, use and carry all those knives inside Canada...just can not buy them out side Canada...does not make any sense...this knife is on ceramic bearing....they can tight the screw as hard as they can....it will still flip open....

RebuswindFunny how everyone is focusing on the flipper part when those changes were already done over a year ago and still most people received their flippers (I've got one seized last year). The part that really bothers me is how now in January they've extended their BS to include pretty much any one-handed opening knife. See daaper's post above, bullet 1 and 2 and understand flipper, thumb stud, thumb disc, spydy hole, etc...

bdpflast time they did not specifically ban flipper....it was just can be interpreted as such.. this time...there was a specific ban on flipper and can be interpreted to all one hand opening folding knife.

RebuswindMaybe, but realistically, they will always interpret it to their interest which is to confiscate the knife, or else, they wouldn't have gone through the trouble of changing things. Back in late 2016, they "interpreted" that my ball bearing flipper was an automatic. For the same reason, I wouldn't be surprised if now they also interpret a Sebenza 25 being an automatic. Bottom line is that in the end, most knives will still go though, but for the lucky ones that get inspected, CBSA can seize pretty much any one-handed opening knife if they want to. It blows my mind that the government sees them do as they please instead of following the actual law and does nothing.

You're not alone... we have a similar law here in NY where pretty much any knife can be considered banned. Something about it "looking like a dangerous/frightening weapon" which they can interpret to be anything they want on a whim... It's arguably worse than the new law you have up there. As for the set-in-stone anti-flipper/gravity/inertia/whatever they want to call them knives... I have found one that my police friends have been baffled by and say that it definitely does not apply... The CRKT Fulcrum. It requires two actions (which you can do in basically one action with practice) to open fully and lock.

bdpfThis is such a freaking shame. I've just started getting an appreciation for pocket knives (after getting the Falcon) and MD for getting decent pricing and competitive international shipping rates and now this happens.... Way to nip a new hobby right in the bud.

KadosYou can still import knives if you have a license (think of a knife as a gun, you can still buy guns from gun shops in Canada but you can't import them yourself) so knife stores won't be affected, it's just normal guys like you and I who can't import knives ourselves to save a buck or two.

Ares78Mentioned the CBSA changes to the person working at House of Knifes and she said they already knew and would not be importing any more flippers. Seems stores are being screwed also.
