There are many more examples and kickstarter projects that claim to be original but in fact have been around in ages in Asia region countries especially from China, Taiwan and Korea. But let's not get too deep in the rabbit hole here.

BASTIONLLCBefore you claim something is a knock-off, first do a proper due diligence. I worked in patents and know how hard it is to come up with an idea that is truly original. If you research this, you will notice that many patents nowadays are very narrowly defined, which means that they are impractical for legal protection because the general forms of the ideas have been around for so long that others can find easy ways to get around the narrow patents and come up with products that are equally as good or better without infringing on the patents. Also, legally speaking, patents only give you the right to file a lawsuit, not to directly prevent others from making products. Only courts can do that, after you file a suit AND successfully prove to the court your patent is strong enough or is truly valid -- because the parties you file the suit against can use this opportunity to challenge the validity of the patent in court and try to prove that it is not truly original and thus should be invalidated. (If you don't have a patent and tries to file a suit, the court will throw out the suit and you will be left with no way to prevent others from copying your product. So having a patent is important in that regard.) In any case, if you don't already have legal protections like patents, then you can't legally make knock-off claims. That is true even if you filed a patent application but have not yet been granted a patent (the so-called "patent pending" situation).
Last year, the maker of a famous brand of metal spinners filed a patent application on their spinner and tried to intimidate other makers from making them. I and others called this a major BS because the basic spinner idea has been around since at least the industrial revolution. Well, the other makers were not intimidated and we have not heard from the patent filer since. I suspect that either their application was denied or it was so narrowly defined that it was practically useless for use in courts.

Glad to see there are legal professionals on the platform chiming in objective statements and opinions to reflect our case. We heard about the famous spinner maker incident trying to intimidate other makers as well.
