The CBSA seized this knife, they state that it is a "weapon" that can be opened with one hand by pushing the flipper tab with one finger.
I advice fellow Canadians to avoid purchasing this and any other knives that open one handed. :-(
I guess that leaves us with nail groove blades.
Oh, and I have a Karambit coming that o am sure it will be seized as well, any thoughts

I received a letter from the Recourse Directorate (the trade appeals unit) with their response to my appeal. Their finding is that the Bestech Hornet is a prohibited weapon.
The basis of their decision seems to be solely on the deployment method "by applying pressure to the knife's flipper or protrusion, the blade opened automatically to the extended position. This is considered opening automatically by hand pressure applied to a button, spring or other device in or attached to the handle of the knife".
It is important to note that the device (flipper tab) is NOT in or on the handle, but on the blade itself, but they concluded that such a flipper protrudes from the handle and is, in fact, considered to be a device attached to the handle. Oh well...
I think that there are other factors not considered such as the law is mostly meant to prohibit the import of knives like balisongs or switchblades; I see a sheep's foot more like a box cutter or even a carving knife (not a weapon). There is also a loophole in the letter of the law as the device is not attached to the handle. In any case, someone with more patience than I can pick up that legal battle, perhaps some sort of class action.
I have 3 options: appeal again to the Canadian International Trade Tribunal, arrange for a return of the knife using a bonded courier who can transport dangerous goods (at exorbitant rates), or abandon the knife. I give up.

I submitted a request to reclassify the knife and deliver it to me. It is still open. If the request is denied I have only two options:
Abandon the item (which I assume gets destroyed)
Arrange for a return to seller using a bonded courier who can transport prohibited weapons. Besides this courier service being overkill and expensive, MD does not accept returns.
I am keeping my fingers crossed
TriaedThanks for coming back to reply... that is just brutal. Hearing this I can't imagine taking a risk on buying a knife from outside of Canada again. Having said that, I'm wondering how Canadian retailers are still getting these products...

The criminal code was updated to include as "prohibited weapons" blades that can be deployed quickly including those with flipper tabs, or by the use of centrifugal force or gravity. There is a memorandum explaimong the deplyment methods and further restricting importation of blades. For example a blade which can be deployed usong some initial preparation motion or skill, then using centrifugal force can be a prohibited weapon... this is ANY blade, even a little Swiss Army knife (you can pull the blade open with your nail just a bit, then swing it open). Of course, this in entirely left to the opinion of the CBSA agent!
Knives that are already in Canada and being sold by merchants should be exempt. Also, merchants or individuals who wish to import any of these knives need to have some sort of license.

I have no idea what the seller used as the export classification as I never saw the package; suffice to say that the CBSA re-classified it based on the opinion
bluequickYup, I did check. It has in fact, changed as of January 2018 to expand the definition of (And to include additional items as) "prohibited weapons"
I do agree it is nonsense blown out of proportion by the CBSA as these items cannot be used to induce mass injuries or killings.

TriaedThe Taliban are alive and well in Canada. It is so sad that a government does not trust its people and that a people allow a government like that to exist.
AntibacterialThere is a purpose to the restriction and that is to stop uncontrolled importation of dangerous items without a license (for example, full auto conversion kits, high capacity clips, etc). This is just ridiculous as this knife is a glorified box cutter.
Funny enough, you can find one handed operated knives in Canada, so their sale is allowed, just not the importation by individuals.

TriaedWhat happened in Oz is there was a big upswing of knife murders ..... basically what was going on was Sudanese refugee gang members were getting cheap kitchen or fishing knives ,,,,committing crimes violence and murder esp against Indian students ..... but the media couldn't report that as I guess that would bias the population against African refugees.. Anyway the result was stupid things like Aldi having to dump advertised specials like a fathers day traditional stockman lockless folder and police and fireman soldiers and first responders being unable to buy suitable tools .....meanwhile available one handed openers jumped in price to ridiculous prices and knife knuts went nuts for one handed folders....
None of this addressed the actual problem of violent crimes because perps arnt going to spend $ on a quality blade and speed or ease of opening makes absolutely NO DIFFERENCE whatsoever. It takes the same time to deploy a 2 handed knife....it just takes 2 hands ......fixed blades can be deployed instantly too.....

I would consider its blade shape far more "aggressive", (from a BS bureaucratic point of view) than the hornet's. So idk. I have no idea how customs actually operates, but perhaps there's a provincial discrepancy in how strictly these new restrictions are enforced? I suppose the point is that if a knife gets stipped by the CBSA it will be entirely up to the opinion of the agent whether it goes through or it is considered a prohibited weapon... which can literally be ANY knife based on the definition
