I purchased Ultimate Ears 18 CIEMS from you two weeks ago, under the impression they were under a discount. Unfortunately, upon receipt of them I learned that they were a discontinued product and were being sold retail for 200 less than I paid Massdrop, and they were replaced with a new product and will no longer be produced anymore. I have called ultimate ears and they told me to contact you. I will pay full retail at the discounted release price for the new version for the new version of the CIEM, but I will not accept this product that was sold under a false pretense.
If the matter is not rectified immediately, I will take my matter to your forums, to head-fi, and to the FTC for false advertising and fraudulent inducement. The product was discontinued 1 day after I received it and replaced with a new product on sale for 200 USD more than I paid for the obsolete product. I’m furious, as I feel as I have been defrauded and cheated, the point of group buying is to get discounted goods at good deals, not closeout items at above retail price. You clearly knew this was a product at the end of its lifecycle being replaced and you went forward with the drop anyway.
This was wrong, and you took good hard earned money form many people that can’t afford to waste it ( fortunately I’m not one of them ), but the whole drop was wrong on the part of both massdrop and Ultimate Ears, and reflects poorly on both brands. What I want and will make me a happy Massdrop and Ultimate Ear customer is to pay the full introductory price for the new CIEM and to return the old model in exchange for the new model. I will not post about this or discuss it anywhere. I really think you should offer this to everyone, but I will not mention it anywhere if you accommodate me.
If you don’t I will attempt to get all the other drop participants to follow me and pay for a legal action against both companies and I believe we will achieve the same results, juts on a larger scale w/ you paying the legal fees. Everyone makes mistakes, it’s time to man up and say maybe this was wrong. We really pissed some customers off. And the few (like me, or if its only me) that are angry, make the problem right. For Ultimate Ears you have a brand that you built that you want to keep pristine for life, for Massdrop, you also don’t want customers to feel cheated. Please come up with a resolution for me, ill pay any reasonable difference. Let’s just compromise so all sides are at piece with the transaction.

sethmwwI would pay 200 more for the new model if it was possible to trade the 18 pros in. I don't know about false advertising but it does seem like they used this drop to clear the old six driver stock. Not sure if Massdrop could be held liable for what UE releases. Do you know for sure Massdrop knew UE was going to release new ciems? It's really bad timing and we all got a raw deal as a result.

John_1Yes massdrop acknowledged to me on the phone last night that they knew about the forthcoming release of the new model. This was clearly against the FTC's guidelines for clear and desscriptive advertising. They said they did the drop at the request of Ultimate Ears which is even worse. It shows that UE, used massdropp as a vehicle to dump an old extinct product on the less eductated consumer that would be less likely to find out about the newer model. Dealers were actually selling the model for less than 999.

sethmwwIt will be interesting to see how Massdrop responds to this. They probably didn't do enough research to see what retailers are doing before creating the drop. Can you post a link to a retailer with a sub $980 price?

John_1I'm at the hospital now, I'll try to find one this evening when I get home from therapy. It seemed like all the sales an discounts were last week right before the launch of the new model though, so i'm not sure if they are still up, but I'm sure I'll be able to find one or two. The new product originally launched in the pre launch sale at 1350 USD. Well worth 350 extra, as it'S a dramatically better monitor by all the people that have reviewed it so far.

Post the screen shots here when you get a chance. Thanks for posting about this. I think Massdrop and UE should offer a paid upgrade to the people in this drop that want the newer model. It's the decent thing to do.
